ORDINANCE 2023-1

AN ORDINANCE OF THE TOWN OF MOUNTAIN VIEW, WYOMING IMPOSING AN EXCISE TAX ON THE SALE OF LODGING SERVICES WITHIN THE TOWN OF MOUNTAIN VIEW, WYOMING, PROVIDING FOR AMENDMENT HEREOF BY AMENDMENT TO STATUTORY PROVISIONS, NOTIFYING THE WYOMING DEPARTMENT OF REVENUE OF ADMINISTRATION OF THIS ORDINANCE AND EXCLUDING ANY EXCISE TAX IMPOSED ON LODGING SERVICES BY THE STATE OF WYOMING.

WHEREAS, pursuant to Title 39 of the Wyoming Statutes, the Town submitted a ballot proposition to voters voting in the 2022 General Election conducted on November 8, 2022, regarding imposition of a excise tax on lodging services sold in the Town; and

WHEREAS the proposition for the imposition of a lodging tax was approved by the majority of those voting within the corporate limits of the Town of Mountain View at the General Election; and

WHEREAS, the town of Mountain View is required by law to enact an ordinance relating to imposition of the excise tax so approved.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF MOUNTAIN VIEW, WYOMING THAT:

Section 1:  There is hereby imposed an excise tax on every sale of lodging services within the Town at the rate two (2%) percent.  The term lodging services and lodging tax shall have those definitions incorporated in Title 39, Chapter 15, Article 1 of the Wyoming Statutes as are now in effect or may hereinafter be enacted.

Section 2:  The administration of said tax shall be in conformance with the following.     

A. The administration of this tax is vested in the Town of Mountain View, Uinta County, Wyoming.

B. The County may provide for issuance of a stamped, tokens or other devices to more efficiently secure payment, collection and accounting for the tax imposed under this ordinance an additional license to engage in business shall not be required if the vendor has been issued a license pursuant to law.

C. Notices required to be mailed under this ordinance are considered mailed to the address shown on the records any notice mailed to the address shall be sufficient for purposes of this Ordinance.

D. No employee or any other person by virtue of his employment who has knowledge of the business affairs of any person filing or required to file any tax returns under this Ordinance shall make known their contents in any manner or permit any person to have access to any returns or information contained therein except as provided by law.  The following may be allowed:

i. The delivery to the taxpayer or his legal representatives upon written request of a copy of a return or a report in connection with his tax;

ii. The publication of statistics so classified to prevent the identification of particular returns or reports;

iii. The inspection by the attorney of the report or return of any person who brings an action against the Town or whom an action is contemplated or has been instituted;

iv. The introduction of any report or return or information therefrom in any administrative or court proceeding to which the person making the report or return is a party;

v. The furnishing of any information to the United States Government and its territories, the District of Columbia, the State of Wyoming or any state allowing similar privileges to the State, or any multi-state tax commission for relay to tax officials of cooperating states and provided however such information shall be only for tax purposes;

vi. The inspection of tax returns and records by the State of Wyoming Department of Audit;

vii. The sharing of information with local governmental entities and other agencies, provided a written requests is made to the governmental entity or agency that demonstrates a sufficient reason to obtain the information for official business purposes.

E. No person shall fail or refuse to make any return or payment required by this Ordinance or shall make any false return or statement or shall evade the payment of any tax due.  No person shall aide or abet another in any attempt to evade the payment of the tax due.  No person shall knowingly attest by signature to a false or fraudulent return.  The District Court in Uinta County, Wyoming in which violations of this ordinance occur shall have jurisdiction over such matters.

Section 3: Any amendments made to Article 1 of Chapter 15 of Title 39 of the Wyoming Statutes or Chapter 16 of Title 39 of the Wyoming Statutes not in conflict with Article 1, Chapter 15 of Title 39 or to Chapter 16 of Title 39 shall automatically become part of this ordinance. 

Section 4: The Town shall contract with the Wyoming Department of Revenue prior to the effective date of this ordinance taking effect that the Department shall perform all functions incident to the administration of this Ordinance.

Section 5: The amount of tax imposed by this ordinance should not include any sales tax imposed by the State of Wyoming.

Section 6: No person is liable for payment of any tax imposed by this ordinance for sale of lodging services made more than one (1) year prior to the date he is notified by the Department of Revenue of his liability for the tax.

This ordinance shall become effective on July 1, 2023.
