ORDINANCE NO. 2019 - 1

AN ORDINANCE AMENDING THE PROHIBITION ON OBSCENE AND THREATENING COMMUNICATIONS

WHEREAS, currently the Town prohibits obscene and threatening

communications; and

WHEREAS, the existing Ordinance needs to be updated to address changes in technology; and

WHEREAS, the existing Ordinance heading does not accurately reflect the contents of the Ordinance.

NOW THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF MOUNTAIN VIEW, UINTA COUNTY, WYOMING THAT THE TOWN CODE SHOULD BE MODIFIED IN THE FOLLOWING WAY: 

11-3-4: OBSCENE AND THREATENING COMMUNICATIONS:

  1. A person commits a misdemeanor if he uses any means of electronic and/or written communication to another and uses threats, obscene, lewd or profane language and/or suggests a lewd or lascivious act with intent to harass.
  2. A person commits a misdemeanor if:
  3. By repeated anonymous communication, he or she disturbs the peace, quiet or privacy of persons where the communication was received; or
  4. He or she communicates to another and threatens to inflict injury or physical harm to any person or property of any person.
  5. A crime under this section is committed at the place where the communication was either originated or were received.
  6. As used in this Ordinance, “Harass” shall mean:

(i) engaging in an act or communication, including but not limited to, threats, written threats, lewd or obscene statements or images, directed at a specific person that the defendant knew or should have known would cause:

(A) A reasonable person to suffer substantial emotional distress;

(B) A reasonable person to suffer substantial fear for their safety or the safety of another person; or

(C) A reasonable person to suffer substantial fear for the destruction of their property.

NOTICE TO BIDDERS

Notice is hereby given that School District #6, Uinta County, Lyman, Wyoming, will receive sealed bids for a turnkey two-way radio system.  This radio system for radio coverage in and between the District sites that meet District and FCC requirements.  The proposed two-way radio system will be a linked trunking system P25 and WYOLINK compliant to provide reliable, efficient, radio and network functionality, and two-way radio communication system and shall accommodate all communications between all district schools and busses.

Bid specifications are available by contacting Tony Gillies, Business Manager at the District Office, Monday thru Thursday from 7:00 am to 4:30 pm, 126 North Franklin Street, Lyman, WY  82937.   Telephone number (307) 786-4100 ext. 4103.

Minutes of the Business Meeting held February 7, 2019

 Present were Mayor Berg, Councilmembers Andy Spray, Tansy Shelton and Dallas Sill, Public Works Director Jared Crane, Clerk Lisa Bradshaw, Chief Kathy Adams and Attorney Thayne Peterson.  Councilman Hooton was present via phone.

Councilman Spray made a motion to approve the agenda, second by Councilman Sill, motion carried unanimously.

Councilwoman Shelton made a motion to approve the minutes of the January 17, 2019 work and business meeting, second by Councilman Spray, motion carried unanimously.

Councilman Sill made a motion to approve the One Day Malt Beverage Catering Permit for Cailen Gibbs on June 15, 2019 at the Heritage Barn, second by Councilman Spray, motion carried unanimously.  Attorney Peterson will draft an ordinance for the next council meeting pertaining to who can cater alcohol in the Town of Lyman.

Councilwoman Shelton made a motion to approve the water bill adjustment for Gary Anderson waiving overage fees, current bill will be $57.00, second by Councilman Spray, motion carried unanimously.
