ORDINANCE 2022-4

AN ORDINANCE OF THE TOWN OF MOUNTAIN VIEW, WYOMING, ANNEXING AND ZONING THE REAL PROPERTY MORE PARTICULARLY DESCRIBED HEREIN AS REQUESTED IN THE PETITION TO ANNEXATION SUBMITTED BY AYRES AND BAKER POLE AND POST, INC.

WHEREAS, the governing body of the Town of Mountain View, Wyoming, did on the 2nd day of August 2022, pass a Resolution declaring the intention of the Town to annex real property into the Town of Mountain View upon the Petition to Annexation filed by Ayres and Baker Pole and Post; and

WHEREAS, an annexation report as specified in Wyo. Stat. §15-1-402 has been prepared for the subject property; and

WHEREAS, said Resolution set a hearing for the 16th  day of August 2022, at 7:00 p.m., at the Council Chambers at Town Hall of the Town of Mountain View, to receive comments from members of the public, to determine if the proposed annexation meets the conditions of Wyo. Stat. §15-1-402 and if the required procedures have been met; and

WHEREAS, notice of the hearing and the annexation report has been published and provided to all landowners and public utilities as required by Wyo. Stat. §15-1-402 and Wyo. Stat. §15-1-405; and

WHEREAS, after considering the evidence presented at the hearing, the governing body for the Town of Mountain View finds the following:

(i) An annexation of the area is for the protection of the health, safety and welfare of the persons residing in the area and in the town;

(ii) The urban development of the area sought to be annexed would constitute a natural, geographical, economic and social part of the annexing town;

(iii) The area sought to be annexed is a logical and feasible addition to the town and the extension of basic and other services customarily available to residents of the town shall, within reason, be available to the area to be annexed;

(iv) The area sought to be annexed is contiguous with or adjacent to the town;

(v) The existing utility franchises are able to serve the proposed annexed area;

(vi) The terms and conditions of the Petition to Annex do exist; and

WHEREAS, the owner of the property described herein has also requested that the property be zoned as Commercial property on annexation;

WHEREAS, the Planning Commission has recommended the Town Council approve the zoning of the property to Commercial.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF MOUNTAIN VIEW, WYOMING, THAT:

Section 1. The real property more particularly described below, is hereby annexed into the Town of Mountain View, Wyoming to-wit:

A PART OF THE SOUTHWEST QUARTER OF SECTION 13, TOWNSHIP 13 NORTH RANGE 115 WEST, 6TH PRINCIPAL MERIDIAN, TOWN OF MOUNTAIN VIEW, UINTAH COUNTY, WYOMING:

BEGINNING ON THE EAST RIGHT OF WAY LINE OF WYOMING SR-414 LOCATED 3,248.50 FEET SOUTH ALONG THE SECTION LINE; AND 60.00 FEET EAST FROM THE NORTHWEST CORNER OF SAID SECTION 13; AND RUNNING THENCE NORTH 359.80 FEET ALONG SAID EAST RIGHT OF WAY LINE TO SOUTHWEST CORNER OF T & N MOUNTAIN VIEW ADDITION (ENTRY NO. 158221) AS IT EXISTS ON THE GROUND; THENCE NORTH 80° 46’06” EAST 243.91 FEET ALONG THE SOUTH LINE OF SAID T & N MOUNTAIN VIEW ADDITION; THENCE SOUTH 356.69 FEET; THENCE SOUTH 80° 02’50” WEST 244.43 FEET TO THE EAST RIGHT OF WAY LINE OF SAID SR-414 AND POINT OF BEGINNING.

OR 1.980 ACRES

Section 2. A certified copy of this annexation ordinance and an annexation map prepared pursuant to W.S. 15-1-402 shall be filed with the County Clerk of Uinta County, Wyoming.

Section 3:  The above-described property is hereby zoned Commercial and the Town is hereby authorized and directed to take all action necessary to implement said zoning.

NOTICE

Notice is hereby given, as required by Wyoming Statute Section 39-13-108, that Isom Land Holdings, LLC, a Wyoming limited liability company (“Isom Land Holdings”), intends to make application to the Unita County, Wyoming Treasurer for a tax deed to Lot 1, Block 2, of the Austin Hills Subdivision, Unita County, Wyoming (the “Property”), which Lot 1 has a street address of 505 Pinnacle Drive, Lyman, Wyoming. Pursuant to Wyoming Statute Section 39-13-108(e)(v), the following information is furnished with respect to Isom Land Holdings application to obtain a tax deed to the Property:

(I) The Property was purchased on September 19, 2018, as shown in that certain Certificate of Purchase of Real Estate Taxes, with Certificate No. 6768 (the “Certificate of Purchase”).  All rights under the Certificate of Purchase were purchased by, and assigned to, Isom Land Holdings on June 13, 2022. 

(II) Record title is presently in the name of Ralph Sohn and Loyola P. Wallberg, and the Property was in those names when it was taxed in 2017.

(III) The Property is Lot 1, Block 2, Austin Hills Subdivision, according to the official plat recorded in Unita County, Wyoming, and has a street address of 505 Pinnacle Drive, Lyman, Wyoming.

(IV) The Certificate of Purchase pertained to real property taxes on the Property for 2017.

(V) Isom Land Holdings’ right to obtain a tax deed pursuant to the Certificate of Purchase will expire on September 19, 2024. The right of the record title holders to redeem the Property will expire when a tax deed is issued to Isom Land Holdings, which will be no less than three months from the date of this Notice.

(VI) Isom Land Holdings will make application for a tax deed to the Property approximately three months after publication and posting of this Notice, as required by Wyoming Statute Section 39-13-108(e)(v), has been accomplished.

(VII) Isom Land Holdings is not aware of any special assessments on the Property for local or public improvements.
